Full course description

Structures by which healthcare is organized and delivered are shaped by licensure, accreditation, and regulatory processes. This course will explore compliance with a focus on healthcare and related fields. The student will become familiar with healthcare system regulation and participation rules, compliance requirements, privacy protection with advances in health technology, and billing and coding compliance. 

Objectives

  • Learners will be able to identify and explain the fundamental principles and key provisions of major healthcare laws in the United States.
  • Learners will understand and apply the legal requirements for maintaining patient confidentiality and privacy, with a focus on HIPAA regulations.
  • Learners will recognize and evaluate various forms of healthcare fraud and abuse, including false claims, kickbacks, and physician self-referrals.
  • Learners will demonstrate knowledge of the legal principles governing healthcare decision-making, including informed consent and advanced directives.
  • Learners will analyze the legal framework of health insurance, including regulations surrounding coverage and the roles of federal and state governments in regulating health insurance.

Instructor

Ryan Kirshenbaum, J.D. is a corporate and healthcare attorney licensed in Nebraska and Iowa, serving as the Lead Staff Attorney for the Nebraska Methodist Health System.  The Nebraska Methodist Health System is comprised of four acute care hospitals (800+ total licensed beds), 30+ physicians clinics, one skilled nursing facility, and one nursing and allied health college.  Ryan is also an Adjunct Professor of Law at Creighton University School of Law, teaching Bioethics and Health Law. 

Ryan’s primary law practice focuses on general health law matters, such as HIPAA, EMTALA, Clinical Research, Stark Law and Anti-Kickback Statute.  Ryan’s corporate practice focuses on general corporate matters, such as mergers and acquisitions, real estate, corporate governance, and data security.  Ryan received his Juris Doctor from the University of Nebraska School of Law, and holds a Bachelor of Arts in Legal Studies from the University of Central Florida (UCF).  Ryan is also involved in the Nebraska State Bar Association, serving on the executive boards of the Health Law and Corporate Counsel sections.  In 2023, the Nebraska Bar Association awarded Ryan with its prestigious Outstanding Young Lawyer of the Year.

Course Outline

 

Healthcare Transactions and Contracts consists of 4 modules that will take approximately 2 hours each to complete. Total course commitment is 8 hours over 2 weeks.
