In the first panel session, seasoned health care ADR professionals will introduce you to the rewarding field of health care ADR from a neutral, attorney, and client perspective. Discover why ADR is a health care "superpower" that offers a myriad of opportunities to positively impact individuals, organizations, and communities. The panel will share a compelling mix of real-world examples and practical advice straight from the frontline of health care ADR practice.

During the second panel session, health care lawyers will help you become familiar with the many benefits that come with making use of ADR in a Health Information Privacy Practice. Integrating ADR into a Health Information Privacy Practice can help resolve conflicts with patients, employees, business partners and in regulatory matters while preserving professional relationships and reputations – all done confidentially.

After participating in this symposium, learners will be able to: 

    • Describe the primary types of ADR and identify which approach is best in a given situation
    • Explain the role of ADR in resolving health care disputes and preserving relationships
    • Recognize opportunities for ADR in the health care space
    • Share at least three best practices for participating in health care ADR
    • Describe the primary benefits of using ADR in Health Information Privacy Disputes/ Matters
    • Explain the role of ADR in resolving health care disputes and preserving relationships
    • Discuss using ADR in negotiating HIPAA settlements with the government, Department of Health and Human Services (HHS) Office for Civil Rights (OCR)
    • Discuss Challenges and other limitations that may exist in making use of ADR in a Health Information Privacy Practice

Denise Hill
Special Instructor, Creighton University School of Law
Attorney/Mediator, Whitfield & Eddy
Denise Hill is a prominent figure in the field of health law and ADR. She maintains a mediation and health law practice with the Whitfield & Eddy law firm in Des Moines. Denise is currently the Chair of the Health Law Section of the Iowa Bar Association, Chair of the Board of Trustees of the National Vaccine Law Association and serves on the Board of the American Academy of ADR Attorneys. With extensive experience in legal practice and academia, Denise has taught ADR and health care courses at prominent institutions, including her current role as a Special Instructor at Creighton Law School. Her innovative approach to conflict resolution and ADR is informed by decades of experience and a commitment to cultural capability and wellness in negotiations.

Michelle Skipper
National Healthcare & Domestic Vice President, American Arbitration Association
Michelle Skipper serves as the National Healthcare & Domestic Vice President for the American Arbitration Association (AAA) in Charlotte, NC. With a robust background in finance and business administration, she oversees the management of complex healthcare arbitrations and is actively involved in business development, recruitment, and training within the healthcare sector. Michelle's career spans over three decades, showcasing her commitment and expertise in managing healthcare practices. Her leadership roles extend to the American Bar Association, where she contributes significantly to health law discussions. Michelle is passionate about fostering innovation in her field and is dedicated to enhancing the efficiency of dispute resolution processes.

Craig Smith
Partner, Global Regulatory, Hogan Lovells
Craig Smith is a Partner with Hogan Lovells based in Miami. He is board-certified in Health Law by the Florida Bar, and Chambers USA ranks him in the top tier of all health care lawyers in Florida. Having served as general counsel at one of the nation's largest state Medicaid programs and health care regulatory agencies, Craig is highly qualified to advise health care industry clients across the nation on complex regulatory issues in transactions and disputes.  He also oversees internal investigations and represents health care providers, managed care organizations, and private investment firms in litigation and arbitration proceedings.

Sarah Gloden Carlson
Associate Professor and Director of the Health Law Program,
Creighton University School of Law
Professor Gloden Carlson joined the faculty of Creighton University School of Law in 2024, where she is the Director of the Health Law Program.  She teaches courses in health law, health information privacy, compliance and conflicts of interest.  She received her J.D. from the University of South Dakota, where she was the graduate research assistant to the General Counsel for the South Dakota Board of Regents, worked at the Freedom Forum’ s Al Neuharth Media Center on projects advancing journalism and education issues involving the First Amendment, held leadership positions in the Native American Law Student Association, the ABA Law Student Division and was an ABA Silver Key award recipient. 

     Following law school, Professor Gloden Carlson worked in Federal Indian Law, Government Contracting, Compliance and Socioeconomic Development for the Winnebago Tribe of Nebraska’s Ho-Chunk, Inc.  She then returned to higher education working as an Assistant Dean at the University of South Dakota, and then was Assistant Dean of the University of Nebraska College of Law, while also teaching in the Undergraduate Honors Program and College of Journalism and Mass Communication.  Most recently, Professor Gloden Carlson served as the Associate Dean at Creighton Law School and  is serving as the  Chief Compliance Officer and Assistant Vice Chancellor for Academic Affairs at the University of Nebraska Medical Center.  

     Professor Gloden Carlson focuses her academic contributions on matters of Health Law and Compliance, Research Compliance, Research Integrity and Conflicts of Interest.

Ryan Kirshenbaum
Associate General Counsel, Methodist Health System
Ryan Kirshenbaum, J.D. is a corporate and healthcare attorney licensed in Nebraska and Iowa, serving as the Associate General Counsel for the Nebraska Methodist Health System.  The Nebraska Methodist Health System is comprised of four acute care hospitals (700+ total licensed beds), 30+ physicians clinics, one skilled nursing facility, and one nursing and allied health college.  Ryan is also an Adjunct Professor of Law at Creighton University School of Law, teaching Bioethics and Health Law. 

     Ryan’s primary law practice focuses on general health law matters, such as HIPAA, EMTALA, Clinical Research, Stark Law and Anti-Kickback Statute.  Ryan’s corporate practice focuses on general corporate matters, such as mergers and acquisitions, real estate, corporate governance, and data security.  Ryan received his Juris Doctor from the University of Nebraska School of Law, and holds a Bachelor of Arts in Legal Studies from the University of Central Florida (UCF).  Ryan is also involved in the Nebraska State Bar Association, serving on the executive boards of the Health Law and Corporate Counsel sections.  In 2023, the Nebraska Bar Association awarded Ryan with its prestigious Outstanding Young Lawyer of the Year.

Cassie Smith-O’Brien
Associate General Counsel and Privacy Officer, Nebraska Medicine
Cassie Smith O’Brien is Associate General Counsel at Nebraska Medicine and Privacy Officer for Nebraska Medicine and UNMC. She provides legal and strategic guidance on healthcare privacy and related issues including HIPAA, 42 CFR Part 2, and the 21st Century Cures Act. Prior to this role, Cassie worked as hospital legal counsel with a focus on healthcare regulations, compliance strategy, and legal risk management. Cassie holds a JD from the University of Iowa College of Law, a Master of Health Administration from the University of Iowa College of Public Health, and is Certified in Healthcare Compliance (CHC).

Abigail T. Mohs
Partner, Baird Holm LLP
Abigail T. Mohs is a member of the firm’s health care practice group. Her practice focuses on regulatory compliance and transactional matters for health care providers with a special emphasis on hospital-physician arrangements and compliance with Federal and state privacy and access laws including HIPAA, Part 2, and Information Blocking. Abby regularly assists clients with the regulatory complexities related to health care transactions of all sizes.  

     Since 2021, Abby has been selected by her peers for inclusion in The Best Lawyers in America: Ones to Watch® in the field of Health Care Law.

     Prior to joining the firm, she worked in insurance contracting and health IT compliance where she gained valuable experience navigating the changing landscape of legal and regulatory matters. Abby received her undergraduate degree from Creighton University and her law degree from Hamline University School of Law.
